Voice Services Acceptable Usage Policy (VSAUP)

Lawful Purpose

Services provided by DLS may be used for any lawful purpose for which the service is technically suited consistent with the transmission and switching parameters of the telecommunications facilities utilized in the provision of the service.

DLS' services are provided subject to the condition that they will not be used for any unlawful and/or fraudulent purpose. Services will not be furnished if any law enforcement agency, acting within its jurisdiction, advises DLS that such services are being used or are likely to be used in violation of the law and/or in a fraudulent manner. If DLS receives other evidence giving reasonable cause to believe that such services are being used or are likely to be used for unlawful and/or fraudulent purposes, it may either discontinue or deny the services and/or refer the matter to the appropriate law enforcement agency in accordance with law and/or Commission rules.

Any individual who uses or receives DLS's services other than under the provisions of an accepted application for service and a current Customer relationship shall be liable for the appropriate rates and charges for the service received and for DLS' costs of investigation and collection.

Equipment and Facilities

The operating characteristics of Customer premises equipment or communications systems connected to DLS' services must not interfere with, or impair, any of the services offered by DLS. Additionally, connected Customer premises equipment must not endanger the safety of DLS employees or the public, damage or interfere with the proper functioning of DLS' equipment, or otherwise injure the public in its use of DLS' services.

The Customer shall be responsible for damages to DLS' facilities used in the provision of regulated services caused by the negligence or willful act of the Customer or those using DLS' service through the Customer. The Customer may not physically modify or intrude upon, rearrange, disconnect, remove, or attempt to repair any of DLS' facilities except upon written consent of DLS.

The Customer's obligation to DLS is the same whether the facilities involved are DLS' facilities or are facilities leased by DLS from another party. If DLS incurs expenses due to the Customer's actions that result in damage or impairment of DLS owned or leased facilities, DLS will pass on to the Customer any and all expenses to repair DLS' facilities or that the owner imposes on DLS for leased facilities.

Cancellation

Customer may cancel service by providing written notice to DLS thirty (30) days prior to cancellation.

Customer is responsible for usage charges while still connected to the DLS' service, even if the customer utilizes services rendered after the Customers request for cancellation has been made notice and the payment of charges, if any, for service has been made.

DLS may immediately discontinue furnishing the service to a Customer without incurring liability:

  • If there is a condition determined in DLS' sole discretion to be hazardous to the Customer, to other Customers of DLS, to DLS' equipment, to the public or to employees or agents of DLS; or
  • If DLS deems refusal or disconnection necessary to protect itself or third parties against fraud or to otherwise protect its personnel, agents, facilities or services; or
  • For non-compliance with and/or violation of any State or municipal law, ordinance or regulation pertaining to the service; or
  • For use of DLS' Services for any purpose other than that described in the application; or
  • In the event of Customer use of equipment in such a manner as to adversely affect DLS' equipment or the Service to others; or
  • In the event of tampering with the equipment furnished and owned by DLS; or
  • In the event of unauthorized or fraudulent use of the service.
  • DLS may discontinue service according to the following conditions upon written notice, pursuant to 83 Illinois Administrative Code Section 735.130(c);

  • For violation of DLS' filed tariffs; or
  • For the non-payment of any proper charge as provided by DLS' Tariff; or
  • For Customer's breach of the contract for service between DLS and Customer.
  • The discontinuance of Service(s) by DLS pursuant to this section does not relieve the Customer of any obligations to pay Company for charges due and owing for Service(s) furnished up to the time of discontinuance. The remedies set forth herein are not exclusive, and DLS is at all times to be entitled to all the rights available to it under law or equity.

    Taxes

    The Customer is responsible for payment of all federal, state and local taxes, franchise, excise and other fees applicable to the Services, including, but not limited to: sales, use, excise, franchise, access, universal service, 911 services and handicapped services.
